Updated: 31 October 2026

เอกสารนี้เผยแพร่เป็นภาษาอังกฤษเท่านั้น

This Prohibited Use Policy (“Policy”) supplements the Nuva Terms of Use, Talent Agreement, applicable License Agreement and License Scope.

It applies to your access to and use of the Nuva Platform, Likeness Assets, Licensed Assets and Digital Likenesses, including content created, generated, modified or distributed using them, whether the activity takes place within or outside the Nuva Platform.

Attempts to engage in prohibited activity, or to assist another person in doing so, are also prohibited.

Capitalized terms not defined in this Policy have the meanings given in the Nuva Terms of Use or applicable License Agreement.

1. Do Not Use Nuva for Illegal Activity

You must not use the Nuva Platform, a Talent's Digital Likeness, Likeness Assets or Licensed Assets to engage in, promote, facilitate or materially support illegal activity.

This includes, for example:

  • fraud, scams or deceptive commercial practices;
  • human trafficking or exploitation;
  • illegal goods or services;
  • illegal drugs, narcotics or controlled substances;
  • unlawful weapons or dangerous materials;
  • money laundering or other financial crime;
  • counterfeit or deceptive goods or services;
  • infringement of intellectual property, privacy, publicity or other legal rights; or
  • content that instructs, encourages or materially facilitates illegal conduct.

Content must not falsely suggest that a Talent participated in, endorsed or was personally involved in illegal activity.

2. Do Not Use Nuva for Pornography or Sexual Exploitation

Nuva prohibits use of a Talent's Digital Likeness or Licensed Assets for:

  • pornography or sexually explicit content;
  • sexual services;
  • non-consensual intimate imagery;
  • sexualized deepfakes;
  • nudity or explicit sexualization created without the Talent's specific authorization;
  • sexual exploitation, coercion or trafficking; or
  • content that portrays or implies a Talent's participation in sexual activity without lawful and specific authorization.

This prohibition applies whether the content is real, fictional, AI-generated, edited or simulated.

3. Do Not Threaten Child Safety

Nuva must not be used to create, distribute, promote or facilitate:

  • child sexual abuse or exploitation;
  • sexualization of minors;
  • grooming;
  • sexually explicit or exploitative depictions involving minors;
  • trafficking or abuse of minors; or
  • harmful impersonation, bullying or exploitation of a minor.

Nuva may report suspected child exploitation or other serious threats to child safety to appropriate authorities where required or permitted by law.

4. Do Not Use Nuva for Gambling or Prohibited Regulated Activities

Nuva prohibits use of a Talent's Digital Likeness to promote, advertise, facilitate or endorse:

  • gambling or betting involving real money or other items of value;
  • casinos, online gambling platforms or betting services;
  • illegal lotteries or wagering schemes;
  • illegal drugs or narcotics; or
  • other activities prohibited by applicable law.

A Talent's Digital Likeness must not be used to create the appearance that the Talent personally participates in or endorses such activities.

5. Do Not Engage in Fraudulent or Harmful Impersonation

You must not use Nuva to deceive others about a Talent's real identity, actions, statements or involvement.

You must not:

  • impersonate the Talent for fraud, identity theft or unauthorized transactions;
  • create fabricated evidence or records;
  • represent AI-generated or simulated conduct as an actual event involving the Talent where doing so would materially mislead others;
  • use a Talent's likeness to obtain money, information, access or other benefits through deception; or
  • falsely represent that a Talent personally communicated with, contracted with or authorized a third party.

A License to use a Digital Likeness does not grant authority to act on behalf of the Talent.

6. Do Not Misrepresent the Talent's Identity, Biography or Endorsement

A Licensed Digital Likeness may portray a fictional character, role or authorized commercial appearance, but must not falsely attribute real-world facts to the Talent.

Unless expressly authorized, you must not:

  • use the Talent's legal name as the name of a fictional or generated character;
  • represent fictional events as part of the Talent's actual biography or personal history;
  • attribute fabricated statements, beliefs, experiences or conduct to the Talent;
  • represent the Talent as personally endorsing a product, service, organization or position;
  • imply that the Talent personally participated in a Production merely because their licensed Digital Likeness appears in it; or
  • create a misleading connection between the Talent and a real person, organization, event or controversy.

A stage name, fictional name or character name may be used where permitted by the applicable License.

7. Do Not Use Nuva for Political Activity

A Talent's Digital Likeness or Licensed Assets must not be used for political activity, regardless of whether the content supports or opposes a particular position.

This includes:

  • political campaigns;
  • election advertising;
  • candidate promotion or opposition;
  • voter persuasion or voter suppression;
  • political fundraising;
  • political party communications;
  • lobbying or political advocacy;
  • impersonation of candidates, elected officials or political figures;
  • content intended to influence an election, referendum or civic process; or
  • representing a Talent as supporting or opposing a political candidate, party, government or political position.

Talent Approval does not override this prohibition unless Nuva expressly changes this Policy to permit the relevant category of use.

8. Do Not Use Nuva for Religious Conversion, Recruitment or Abusive Belief-Based Promotion

You must not use a Talent’s Digital Likeness, Likeness Assets or Licensed Assets to:

  • solicit, encourage or promote religious conversion;
  • recruit people into a religion, sect or belief-based organization; or
  • promote or facilitate coercive, deceptive, exploitative or unlawful belief-based practices.

These prohibitions apply to the licensed Production, AI-generated depictions, related promotional materials, calls to action and associated links. Talent Approval, Auto-Casting authorization, Admin review or an add-on purchase cannot override them.

Other religious depictions or endorsements may be permitted only within the applicable License Scope and with the required specific Talent Approval. Such approval must identify the intended context, statements, imagery and boundaries and be recorded in the License record. It must not authorize conversion, recruitment or any other activity prohibited above.

This section does not classify any religion or belief as inherently false or harmful. Neutral cultural, historical, educational or fictional depictions remain subject to the applicable License Scope, approval requirements and all other restrictions under this Policy.

9. Do Not Use Nuva for Geopolitical Conflict or Socially Harmful Manipulation

You must not use a Talent's Digital Likeness or Licensed Assets to create, promote or materially support:

  • geopolitical propaganda;
  • state or military propaganda;
  • content advocating or promoting armed conflict;
  • deceptive content concerning war, terrorism, civil unrest or humanitarian crises;
  • content designed to inflame ethnic, national, religious or social conflict;
  • deliberate disinformation likely to cause significant public harm;
  • dehumanizing or inhumane portrayals of individuals or groups; or
  • content that falsely places a Talent in a real-world geopolitical conflict, humanitarian crisis or socially sensitive event.

Documentary, journalistic, historical or fictional contexts do not automatically create permission to use a Talent's Digital Likeness. The applicable License Scope and this Policy continue to apply.

10. Do Not Create Hateful, Violent, Abusive or Exploitative Content

You must not use Nuva to create or distribute content that:

  • promotes terrorism or violent extremism;
  • threatens or incites violence;
  • promotes hatred or discrimination against protected groups;
  • celebrates or encourages serious human suffering;
  • promotes human trafficking, torture or sexual violence;
  • harasses, stalks, humiliates or threatens an identifiable person;
  • promotes self-harm or suicide; or
  • uses a Talent's likeness in a degrading, dehumanizing or seriously abusive manner.

Fictional depictions may still be prohibited where they violate the Talent's License Scope, Sensitive Use settings or other restrictions under this Policy.

11. Do Not Exceed the Talent's Authorized License Scope

A License grants only the rights expressly stated in its License Scope.

You must comply with all Talent-defined restrictions incorporated into the License, including applicable restrictions concerning:

  • Usage;
  • Production type;
  • industry or product category;
  • Territory;
  • Duration;
  • media and distribution;
  • Commercial Use;
  • AI Generation;
  • AI Training;
  • Sensitive Uses;
  • Sublicensing; and
  • additional rights or distribution channels.

For Auto-Casting Licenses, the Producer must ensure that the intended use falls entirely within the scope authorized in advance by the Talent.

Auto-Casting does not create unrestricted permission.

Where a proposed use exceeds or materially differs from the authorized scope, additional Talent Approval, a License amendment or a new License may be required before the use begins.

12. Do Not Create or Reuse an Unauthorized Digital Human

Unless expressly authorized by the applicable License, you must not use Licensed Assets or a Talent's Digital Likeness to:

  • create a reusable digital avatar, digital human, virtual person or persistent digital identity;
  • create or maintain a Talent-specific model, adapter, embedding or similar reusable representation;
  • reconstruct or replicate the Talent for uses outside the licensed Production or purpose;
  • extract the Talent's likeness into a reusable asset library or dataset;
  • transfer a generated likeness system to another party; or
  • reuse the Talent's Digital Likeness after the applicable License has expired or outside its License Scope.

Authorization to generate content does not automatically authorize creation of a reusable digital avatar or model.

13. Do Not Use Licensed Assets for Unauthorized AI Training

AI Generation permission and AI Training permission are separate.

Unless AI Training is expressly authorized in the applicable License Scope, you must not use Likeness Assets, Licensed Assets or generated representations of the Talent to:

  • train or fine-tune an AI model;
  • create a Talent-specific LoRA, adapter or equivalent model component;
  • develop or improve facial-generation or identity-replication models;
  • build training, evaluation or benchmarking datasets;
  • allow an external AI provider to retain the assets for independent model training; or
  • otherwise create persistent learned representations of the Talent.

Use of an external AI service does not expand the rights granted by Nuva.

14. Do Not Publish, Resell or Redistribute Licensed Assets

Licensed Assets are provided solely for use within the rights granted under the applicable License. Receiving or downloading a Licensed Asset does not give you the right to make the underlying asset publicly available or to distribute it for independent use by others.

Unless expressly permitted by the applicable License, you must not:

  • publicly upload, post or publish the original or downloadable Licensed Asset in a manner that allows others to download, copy, extract or independently reuse it;
  • make Licensed Assets available through public file-sharing services, public cloud folders, asset libraries, repositories, datasets, stock-media platforms or similar services;
  • sell, resell, rent, license, sublicense, give away or otherwise distribute Licensed Assets as standalone assets;
  • include Licensed Assets in an asset pack, template, dataset, model-training dataset, digital library or other collection intended for reuse by third parties;
  • provide another person with access to Licensed Assets for purposes unrelated to the licensed Production;
  • transfer Licensed Assets or Digital Likeness rights to another person or organization except as expressly permitted by the applicable License; or
  • enable any third party to independently create new content from, commercialize or otherwise exploit the Talent's Digital Likeness outside the applicable License Scope.

Licensed Assets may be shared with authorized employees, agencies, production vendors, contractors or technical service providers only where reasonably necessary to produce the licensed Production and only within the applicable License Scope. Such access does not grant those parties any independent right to use, retain, resell, redistribute or exploit the Licensed Assets or the Talent's Digital Likeness.

Publication of the Final Production

This restriction does not prevent the Licensee from publishing, distributing or displaying a completed Production in the media, Territory, Duration and other channels expressly permitted by the applicable License.

However, publication of the completed Production does not authorize publication or distribution of the underlying Licensed Assets as separately downloadable or reusable materials.

15. Do Not Circumvent Nuva's Safety, Licensing or Traceability Systems

You must not:

  • falsify a License, Production Certificate or Talent Approval;
  • remove, alter or intentionally defeat a watermark or provenance mechanism for the purpose of concealing misuse;
  • manipulate License IDs, Asset IDs or other Nuva records;
  • bypass approval, payment, licensing or access controls;
  • scrape or bulk-download Talent profiles or Likeness Assets without authorization;
  • create unauthorized likeness datasets from the Platform;
  • access another User's account without permission;
  • introduce malicious code or interfere with the Platform; or
  • structure transactions, project descriptions or accounts to evade Nuva's licensing or safety controls.

16. External AI and Production Services

Where Licensed Assets are used with an external AI, editing, production or technology service, the Licensee remains responsible for ensuring that use of that service is compatible with the applicable License.

You must not submit Licensed Assets to a third-party service where its terms or technical settings would give that provider rights exceeding the applicable License, including unauthorized rights to retain, reuse, publish, sublicense or train on the Talent's likeness.

17. Additional Talent Restrictions

A Talent may impose additional restrictions through their licensing settings, Auto-Casting authorization, Sensitive Use settings or transaction-specific Talent Approval.

Where such restrictions are incorporated into an issued License, the Licensee must comply with them even where the relevant activity is not categorically prohibited by this Policy.

Talent Approval cannot authorize activity that is categorically prohibited under this Policy or unlawful under applicable law.

Enforcement

Nuva may use Platform controls, automated systems, User reports, transaction records and human review to identify or investigate potential violations of this Policy.

Where Nuva reasonably determines that this Policy, an applicable License or applicable law may have been violated, Nuva may take proportionate action, including:

  • rejecting a licensing request;
  • requiring additional information or review;
  • removing or restricting access to material;
  • suspending or restricting an account;
  • suspending asset delivery;
  • terminating access where permitted under the applicable agreement;
  • preserving relevant evidence;
  • notifying affected Talent or Licensees; or
  • contacting or cooperating with competent authorities where required or permitted by law.

A serious violation involving fraud, exploitation, illegal activity, intentional misuse of a Talent's identity or other material harm may result in immediate restriction or termination.

Nuva reserves the right to pursue contractual, injunctive, monetary or other legal remedies available under the applicable agreement or law against unauthorized use of a Talent's Digital Likeness or other material violations.

Failure by Nuva to enforce this Policy in one instance does not waive its right to enforce it in another.

Reporting Misuse

Suspected misuse of a Talent's Digital Likeness, Licensed Assets or the Nuva Platform may be reported through Nuva's reporting tools or at legal@nuva-license.com

Where available, a report should include the relevant Talent, Asset, License, Delivery or Production reference and supporting information sufficient for Nuva to review the concern.

Appeals

If you believe Nuva has incorrectly restricted your account, rejected a use or taken enforcement action against your content or License, you may request review through Nuva's complaint and appeal process.

Submitting an appeal does not authorize continued use that has been suspended or identified as potentially outside the applicable License Scope.

Updates to this Policy

Nuva may update this Policy from time to time to reflect changes in law, safety standards, technology, Platform functionality or Nuva's services.

Material changes will be communicated where required by applicable law.

An update to this Policy does not silently expand or reduce the rights already granted under an issued License. Any change to an existing License remains subject to its applicable License Agreement, License Scope and mandatory law.
